By accessing or using Grappll ("Service", "we", "our"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these terms. If you do not agree, do not use the Service.
Grappll is a cloud-based gym management platform that allows gym owners and administrators to manage members, attendance, billing, class schedules, leads, and communications. The Service is operated from Vancouver, British Columbia, Canada.
You must create an account to use the Service. You agree to:
You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.
Access to the Service requires a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Fees are billed in advance on a monthly basis and are non-refundable except as required by law.
We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
Payment processing is handled by Stripe. By providing payment information, you agree to Stripe's terms of service. We do not store your payment card information.
We may offer a free trial period. At the end of the trial, your account will be automatically transitioned to a paid subscription unless you cancel before the trial ends. We reserve the right to modify or terminate free trial offers at any time.
You agree not to use the Service to:
You retain ownership of all data you input into the Service, including data about your gym members ("Customer Data"). You grant us a limited licence to process Customer Data solely to provide the Service.
You are responsible for obtaining any necessary consents from your gym members to collect and process their personal information through our Service, in compliance with applicable privacy laws including British Columbia's Personal Information Protection Act (PIPA) and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
Upon termination, you may export your Customer Data. We will retain your data for 30 days after termination, after which it may be deleted.
The Service, including its design, software, and content, is owned by Grappll and protected by copyright and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it as described here.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by applicable law, Grappll shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You may cancel your subscription at any time through your account settings. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Vancouver, British Columbia.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such notice constitutes your acceptance of the updated Terms.
